Terms of Service

These terms explain the rules that apply when you use InstaScheduler.

1. The Service

InstaScheduler is a social media scheduling tool provided by LudeHQ, based in Larnaca, Cyprus. It lets users create, store, schedule and publish content to connected Instagram and Facebook accounts. The Service is currently available by invitation only. By using the Service, you agree to these terms.

If paid plans launch, pricing and billing terms will be added here and shown at checkout.

2. Accounts

You must provide accurate information and keep your account details current. You are responsible for keeping your credentials confidential and for activity under your account. Tell us promptly at contact@ludehq.com if you believe someone has accessed your account without permission.

3. Acceptable use

You may use the Service only for lawful purposes. In particular, you must not:

  • Schedule or publish content unless you have the rights and permissions to do so.
  • Use the Service in a way that breaches Instagram or Facebook platform terms.
  • Publish unlawful, infringing, fraudulent, deceptive or impersonating content.
  • Abuse, disrupt or overload the Service, probe its security or try to bypass access controls.
  • Use another person's account without permission.

We may suspend or end access if you materially breach these terms, create a security risk or expose us or another person to legal liability. Where practical, we will tell you why and give you an opportunity to correct the issue.

4. Your content

You retain ownership of the content you create or upload. You give LudeHQ a limited permission to store, process, copy and transmit that content solely to operate the Service and publish it on your behalf. This permission lasts only while needed to provide the Service or meet a legal obligation.

You are responsible for your content and for ensuring that it does not violate the law, these terms or the rights of another person. Our handling of personal data is described in the Privacy Policy.

5. AI features

AI output may be inaccurate, incomplete or unsuitable for your intended audience. You must review and, where needed, edit AI output before publishing it. You are responsible for the content you choose to publish, including content created with an AI feature.

6. Third party platforms

We are not affiliated with, endorsed by or sponsored by Meta. Your use of Instagram and Facebook remains subject to their terms and policies. Publishing depends on their application programming interfaces. Meta may change, restrict or interrupt those interfaces, which can delay or prevent a post from being published. We are not responsible for interruptions caused by a third party platform outside our control.

7. Availability and changes

We aim to keep the Service available, but we do not promise uninterrupted access. We may maintain, change or stop parts of the Service. We may also update these terms when the Service or the law changes. We will provide reasonable notice of a material change when practical. The date above shows when these terms were last updated.

8. No warranty

To the fullest extent permitted by law, the Service is provided as is and as available. We do not promise that it will always be secure, error free or suitable for every purpose. Nothing in this section limits any warranty or consumer right that cannot be excluded by law.

9. Limitation of liability

To the fullest extent permitted by law, LudeHQ is not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, business, goodwill or data. Our total liability arising from the Service or these terms will not exceed the amount you paid us for the Service during the 12 months before the event that gave rise to the claim.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or for death or personal injury caused by negligence.

10. Intellectual property

LudeHQ and its licensors own the Service, including its software, design, branding and documentation. These terms do not transfer those rights to you. Your ownership of your content is not affected.

11. Governing law

These terms are governed by the laws of the Republic of Cyprus. The courts of Larnaca have jurisdiction. If you are a consumer, this does not affect mandatory consumer protection rights in your country of residence or any right to bring a claim in the courts of that country where applicable.
